MA SJC: Smell of burnt marijuana not enough to pull suspect out of car

Boston Globe: "SJC: Odor of marijuana not enough to order suspect out of car"
"Without at least some other additional fact to bolster a reasonable suspicion of criminal activity, the odor of burnt marijuana alone cannot reasonably provide suspicion of criminal activity to justify an exit order," the court ruled in a decision written by Chief Justice Roderick Ireland.

Keep in mind that OUI of marijuana is still a crime in Massachusetts.

Let me repeat that, driving a motor vehicle while puffing some weed is still a crime in Massachusetts.
